About This Service

The Jack Murphy Clothing mobile messaging service (the "Service") allows you to receive promotional text messages about our products, offers, and news. These Mobile Terms explain how the Service works and your rights.

Important: You must be at least 16 years old to sign up for marketing messages from us.

Your Consent

By providing your mobile number and opting in, you give your explicit, freely-given consent under GDPR to receive marketing SMS messages from Jack Murphy Clothing.

You have the right to withdraw this consent at any time. Simply click the unsubscribe link in any message. You'll receive one confirmation message, then no further marketing messages will be sent.

You'll receive one confirmation message, then no further messages unless you opt in again.

Note: If you've subscribed to other Jack Murphy Clothing message programs (e.g., transactional order updates), you'll need to opt out of those separately.

Getting Help

For assistance with the Service:

We may change the short code or telephone number we use for the Service. If this happens, we'll notify you. Messages sent to old numbers after we've changed them may not be received.

Your Responsibilities

  • Provide a valid mobile number that you own and control
  • Update your mobile number if it changes by re-subscribing with your new number
  • Ensure you're at least 16 years old
  • Check with your mobile carrier about message costs

Data Protection & Privacy

We are the data controller for your personal information under GDPR.

What data we collect: Your mobile phone number, opt-in timestamp, message interaction data (delivery status, clicks).

How we use it: Only to send you the marketing messages you've consented to receive.

How long we keep it: 12 months after you unsubscribe, unless required longer for legal or accounting purposes.

Third-party processors: We use Klaviyo to deliver messages. We use Standard Contractual Clauses approved by the European Commission to protect your data.

We will not:

  • Sell your phone number to third parties
  • Share it with other companies for their marketing purposes
  • Use it for purposes beyond what you've consented to

Limitations of the Service

Technical limitations:
Message delivery depends on your mobile carrier's network. We and the wireless carriers are not responsible for delayed, failed, or undelivered messages due to technical issues outside our control (e.g., network outages, your phone being turned off).

Changes to the Service:
We may modify, suspend, or discontinue the Service or any of its features at any time. We'll provide reasonable notice where practicable. We may also update these Mobile Terms by posting the revised version with a new "Last updated" date. Continued use of the Service after changes constitutes your acceptance.

Our Liability

Nothing in these terms limits our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be excluded or limited under Irish or EU law

To the extent permitted by law:
We are not liable for losses arising from technical failures outside our reasonable control, such as mobile carrier delays, network outages, or misdirected messages. You should not rely solely on text messages for time-sensitive information.

Governing Law

These Mobile Terms are governed by the laws of Ireland. Any disputes will be subject to the exclusive jurisdiction of the Irish courts.

If you are a consumer, you may also bring proceedings in the courts of the country where you live, and nothing in these terms affects your statutory consumer rights under Irish or EU law.
